These Terms & Conditions (“Terms”) form a binding agreement between you and Online Vape Shop USA(“we”, “us”). By accessing the Site, creating an account, or placing an order, you accept these Terms. If you do not agree, do not use the Site.

2. No Sales to Minors

6. Payment

You authorize us and our payment processors to charge your selected payment method for the total order amount, including taxes, shipping, and applicable fees. Chargebacks made without first contacting us in good faith may result in account termination.

7. Shipping & PACT Act

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONLINE VAPE SHOP USA AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OR MISUSE OF THE SITE OR PRODUCTS. OUR AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM IN THE PRIOR 90 DAYS.

You agree to defend, indemnify, and hold harmless Online Vape Shop USA, its affiliates, and personnel from any claims, damages, liabilities, costs, and fees (including reasonable attorneys’ fees) arising from (a) your use or misuse of the Site or products, (b) your violation of these Terms or any law, or (c) your violation of any third-party rights.

14. Governing Law & Venue

These Terms are governed by the laws of the State of Delaware, without regard to conflicts of laws principles. Exclusive venue for any dispute is the state and federal courts located in Delaware, and you consent to personal jurisdiction there.

15. Dispute Resolution & Class Waiver

Any dispute will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Rules. You waive any right to a jury trial and to participate in a class, collective, or representative action. You may opt out by emailing support@ebvapes.com within 30 days of first accepting these Terms.

16. Termination

We may suspend or terminate your account or refuse service at any time, with or without cause or notice.

17. Severability & Entire Agreement

If any provision is unenforceable, the remainder remains in effect. These Terms, together with our other policies linked in the footer, are the entire agreement between you and us.

18. Changes

We may revise these Terms at any time. Your continued use of the Site constitutes acceptance.
