Copyright, trademark, and takedown procedures
1. Respect for IP
Online Vape Shop USA respects the intellectual property rights of others and expects users to do the same. We respond to clear notices of alleged copyright infringement under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.
2. Trademark Notice
All product names, brand names, logos, and trademarks shown on this Site are the property of their respective owners and are used solely for identification and descriptive purposes. Their appearance does not imply endorsement, sponsorship, or affiliation.
3. Submitting a DMCA Takedown Notice
To submit a notice of alleged copyright infringement, email support@ebvapes.com with the following:
- A physical or electronic signature of the copyright owner or authorized agent.
- Identification of the copyrighted work claimed to be infringed.
- The URL(s) of the allegedly infringing material on our Site, with enough detail for us to locate it.
- Your contact information (name, address, telephone, email).
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorized to act on behalf of the owner.
4. Counter-Notice
If you believe content was removed by mistake or misidentification, you may submit a counter-notice including your identification, contact information, the removed material’s URL, a sworn statement of good-faith belief that removal was a mistake, and consent to federal court jurisdiction.
5. Repeat Infringer Policy
We may terminate accounts and refuse service to repeat infringers in appropriate circumstances.
6. Misrepresentation
Knowingly materially misrepresenting that material is infringing, or that material was removed by mistake, may result in liability under 17 U.S.C. § 512(f).
